1. Acceptance of Terms

By downloading, installing, or using any application developed by Sems Turgut ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our applications.

2. Description of Service

We provide various iOS applications including but not limited to:

• Structured Digital Planner - Productivity and organization tools
• Kanky - Educational exam preparation materials
• Card Value Scanner (TCGScan) - Trading card identification and valuation
• Bird Identifier (BirdScan) - Bird species identification
• Plant Identifier (PlantScan) - Plant species identification
• Banknote Identifier (DollarID) - Currency identification
• Cover Letter Creator AI - AI-assisted document creation
• AI Emojis for Keyboard - Custom emoji generation

3. License and Usage Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to download and use our applications for personal, non-commercial purposes. This license does not allow you to:

• Copy, modify, or create derivative works of our applications
• Reverse engineer, decompile, or disassemble our applications
• Remove any copyright, trademark, or other proprietary notices
• Use our applications for any illegal or unauthorized purpose
• Distribute, rent, lease, or sublicense our applications

4. User Conduct

You agree to use our applications responsibly and in accordance with all applicable laws and regulations. You will not:

• Use the applications to violate any local, state, national, or international law
• Transmit any harmful, offensive, or inappropriate content
• Interfere with or disrupt the applications' functionality
• Attempt to gain unauthorized access to our systems or networks
• Use the applications to spam, harass, or harm others

5. Intellectual Property

All content, features, and functionality of our applications, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are owned by Sems Turgut and are protected by copyright, trademark, and other intellectual property laws.

6. Privacy and Data Collection

Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and disclose your information when you use our applications.

7. App Store Terms

Your use of our applications is also subject to the terms and conditions of the Apple App Store. In case of any conflict between these Terms and the App Store terms, the App Store terms shall prevail.

8. Disclaimers and Limitations

Our applications are provided "as is" without any warranties, express or implied. We do not guarantee that:

• The applications will meet your specific requirements
• The applications will be error-free or uninterrupted
• Any identification or scanning results will be 100% accurate
• The applications will be compatible with all devices or operating systems

9. Limitation of Liability

To the maximum extent permitted by law, Sems Turgut shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our applications.

10. Indemnification

You agree to indemnify and hold harmless Sems Turgut from any claims, damages, or expenses (including attorney fees) arising from your use of our applications or violation of these Terms.

11. Termination

We may terminate or suspend your access to our applications at any time, without prior notice, for any reason, including if you violate these Terms. Upon termination, you must cease all use of our applications and delete them from your devices.

12. Updates and Modifications

We reserve the right to modify these Terms at any time. We will notify users of significant changes through app updates or other appropriate means. Your continued use of our applications after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of Turkish courts.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
